Kuwait has introduced a new media regulation framework covering social media influencers, bloggers, vloggers, digital publishers and online advertisers.
Decree-Law No. 102 of 2026, published in the Official Gazette in October, consolidates rules previously spread across laws governing publications, audiovisual media and electronic media. It also extends the framework to digital news platforms, online advertising, social media promotions and other professional media activities.
The law distinguishes personal social media use from professional or commercial activity. Creators who promote products, services, brands or events, including through gifts, free products or other benefits, may require a licence. Licences are set to last for two years and applicants must be at least 18. The Ministry of Information has 60 days to decide on applications, with no decision within that period treated as a rejection.
Sponsored content must be clearly disclosed, while misleading or exaggerated advertising claims are prohibited. Giveaways and contests may require prior permits, and parental permission is required when minors appear in commercial marketing.
Violations involving unlicensed promotions, undisclosed sponsorships or misleading information can result in fines ranging from KD 1,000 to KD 50,000, alongside warnings, suspension or licence revocation. In some cases, courts may order a news website or social media account to be blocked or closed for up to one year.
The law will take effect six months after publication. Executive regulations will define the detailed licensing and compliance requirements.
